Check out the new article from the AIA Surety Team on the irony of cashless bail policies.  In a new report from the Bail Project, bail reform proponents are trying to link the move by several states to preventative detention on surety bail.  What they don’t realize is that their own soft on crime cashless bail policies have created one of the most substantial crime waves we have seen in recent years.  The knee jerk reaction of several jurisdictions has been to move too far in the other direction and push for preventative detention.  Below is a brief section of the article.

The Bail Project’s Report on Pretrial Justice: A Critique of Cashless Bail and Bail Reform

The Bail Project released a new report on January 13th entitled “Detention by Design: The Constitutional Crossroads of Pretrial Justice.” The report aims to provide a constitutional history of bail but veers quickly into activism. As it often does, the Bail Project targets judges, law enforcement, and bail bond agents for any and all issues in the system, particularly the recent nationwide trend of states amending their constitutions to permit preventative detention.
